Terms & Conditions for International Website Orders

These terms and conditions apply to goods ordered through our website for delivery outside Australia.

Freight Options
Free shipping offer only applies to orders delivered within Australia. Freight cost & expected delivery time will be advised by email, once the order is received. Goods will only be despatched when full payment is cleared into our account.

Delivery
Our freight carriers may require a signature at time of delivery and are NOT able to schedule deliveries or call you prior to delivery.
(a) Re-direction; Please ensure you provide the correct delivery address on your order as a re-direction fee may be charged if the goods cannot be delivered to the address you specified on the order.
(b) Re-delivery; Please ensure an elligable person is in attendance at the delivery address to receive goods or a re-delivery fee may be charged if the goods cannot be delivered to the address you specified on the order.
(c) Swe-Check reserves the right to stipulate the freight carrier and delivery requirements of any order.
(d) Any discrepancies in deliveries must be notified to us within 7 days of receipt of goods.

Risk & Insurance
The Goods shall be delivered to the Customer's address as notified to the Supplier at the time of order. Once the goods have been despatched from Swe-Check's premises to the Customer, the risk of any loss or damage to or deterioration of the Goods for whatever cause arising shall be borne by the Customer.

Import Duties & Taxes
Goods shipped outside Australia may incur customs duties, taxes and clearance fees etc. These charges will be payable by the Customer. These fees are not included in any freight fees we may quote or charge. Australian taxes are not charged on goods exported to other countries.

Backorders
Online Stock quantities are updated daily but subject to prior sales.
- You will be advised at checkout of any expected backorder quantities.
- Once your order is received, we will advise an expected delivery date for any backorders.
- Your order will be shipped as a single consignment when backorder items arrive. Alternatively, the customer pays shipping costs for backorder items requested to be shipped seperately.
- Should an unexpected stock shortage occur, we will advise you of the backorder and await your decision on how to proceed. Note: some products may no longer be available or become special order (indent) items when existing stocks are depleted.

Pricing
All prices are expressed in Australian Dollars and are subject to change without prior notice. No responsibility is accepted for any error or omission. Prices for special order items may be quoted based on a specified currency and quoted exchange rate. Please refer to the 'Exchange Rate Variations' clause.

Minimum Order Value
Minimum goods value for orders shipped to international destinations is AUD 250.00. Orders shipped to countries in the European Union (EU) must meet a minimum goods value of EUR 150.01. Freight is an additional cost and will be advised by email.

Goods & Services Tax (GST)
Australian GST is not applicable to overseas shipments and will be deducted from pricing once a foreign country is selected at checkout.

Payment
We only accept credit card payments (Visa, Mastercard & AMEX) from some countries and may require payment via Bank Transfer. A package and handling fee of AU$ 30.00 may be charged for international orders. Special order (indent) items will require full payment before we order the goods. Unpaid orders will be considered cancelled after a period of 7 days. Ownership of the goods does not pass until such time as the goods are paid in full.

Order Cancellation or Variation
Orders for indent items may NOT be cancelled once an order has been placed with the supplier.

Return of Goods
1. If goods are faulty or the reason for return is covered by the Australian Fair Trading Act & Trade Practices Act.
We will refund or exchange goods.

2. If goods are incorrectly supplied.
We will exchange goods for correct item.

3. If goods are incorrectly ordered or you change your mind.
Swe-Check may accept return of goods. A restocking fee of 20% may be charged. Customer must pay return freight costs and the original shipping charges will not be refunded. Special order (indent) items will not be accepted for return. If goods were purchased using American Express card, an additional fee of 1.5% will be charged.

NOTE: Before returning goods, please contact Swe-Check for an ‘Approved Returns’ form.
Returned goods will only be accepted if they are;
- returned in the same condition as delivered.
- accompanied by an ‘Approved Returns’ form.
- returned within the specified time frame.

Exchange Rate Variations
The Customer will be notified if the order is subject to an exchange rate variation. Swe-Check will cover variations of up to +/-2% of the quoted exchange rate. Any variation greater than +/-2% between the quoted exchange rate and the bank sell rate at date of invoice shall be applied to the Buyer's account resulting in an extra cost in the event of a less favourable rate or credit in the event of a more favourable rate. The Buyer accepts the bank sell exchange rate applicable at the date of the invoice as notified by Swe-Check.

Force Majeure
Swe-Check will not be liable for any failure to deliver or any delay in delivery due to any cause beyond its control including but not limited to Acts of God, fires, labour disputes, inability to obtain material or government actions. In the event of any such delay the date of delivery will be extended by a period equal to the time lost by reason of such delay.

Warranty
The only warranty applicable to the goods is any written warranty included in the quotation. Swe-Check shall not be liable for any personal injury, property damage, negligence or otherwise by Swe-Check, its servants or associated entities.

Waiver
If Swe-Check fails or neglects to enforce at any time the provisions of this agreement this shall not:
- be construed, nor shall it be deemed to be, a waiver of any of Swe-Check's rights;
- in any way affect the validity of the whole or any part of this agreement or prejudice Swe-Check's right to take subsequent action.

Severability
In the event that any part of the provisions of this agreement are deemed to be invalid, unlawful or unenforceable to any extent, such provision shall be severed from the remaining provisions which shall continue to be valid and enforceable to the fullest extent permitted by law.

Law
Swe-Check and the buyer agree that the provisions of this agreement shall, in the event of dispute, be construed in accordance with the law of the State of Victoria and be resolved by a Victorian court.

Costs, Expenses and Disbursements
All costs, expenses or disbursements incurred by Swe-Check in the maintenance of the Customer's account including debt collection agency fees and legal costs arising:
- As a consequence of the Customer's default in observing the terms and conditions of sale;
- As a result of any of the Customer's cheques being dishonoured; or by reason of Swe-Check requiring any further security to be provided; shall be payable by the Customer upon demand.

Breach
Any one of the following acts by the customer shall constitute a breach of the customer’s obligations hereunder:
- failure to make payment for the goods when payment is due.
- failure to accept delivery of goods supplied as per customer’s order.
- return of goods without consent
- any other act by the customer in violation of any of the provisions hereof.
In the event of a breach by the customer, Swe-Check may terminate the customer’s order or any part thereof without any liability costs, including but not limited to reasonable legal fees incurred by Swe-Check in any effort to collect payment owing or otherwise enforce rights hereunder.

Swe-Check reserves the right to change or update, without notice, any information published on this website or in our printed literature. Original manufacturers products may change, without notice, in design, construction, materials, processing, or specification, including discontinuation, limit production or change distribution agreements.
